Highlights 

  • 39.6% top tax bracket for individuals over $400,000 and couples over $450,000 plus a 3.8% Net Investment Income Tax (NII) for income over $200K and $250K.

  • Threshold for deducting medical expenses rose from 7.5% to 10% for taxpayers under age 65.

  • A new penalty is assessed on your income tax return if you do not have the appropriate medical insurance coverage.
  • FINRA is now cautioning people about unintended consequences resulting from the broadened in-plan 401(k) Roth conversion of vested balances rules, that now include basically everything in a traditional 401(k) -
       Note: there is no Roth-IRA-like recharacterization feature for these 401(k) conversions
       To get the availability of the recharacterization feature taxpayers would still need to first convert their 401(k) to an IRA, a much more daunting procedure
  • $5,340,000 lifetime gift tax exclusion for 2013, but rate is now 40% (other provisions may have tax rates of 45%)
  • Annual Gift tax exclusion remains unchanged at $14,000.
  • 179 deduction for for LHI has ended.
  • 15-year SL cost recovery for LHI has ended.
  • 50% bonus depreciation has ended.
  • "Automatic" Safe Harbor $1,500 Home Office deduction @ 5/sq ft allowed starting in 2013.(depreciation is not taken) see Rev. Proc. 2013-13
